Terms of Service

The terms that apply when you use our website and order a portrait from Tahanan Frames by Lit Studios.

1. Who we are

Tahanan Frames is a personalised family portrait service by Lit Studios. Lit Studios operates under the registered trade name LIT.STUDIOS PHOTOGRAPHY AND VIDEOGRAPHY SERVICES, with business address at G/F JRSL Building, 584 Dalupan St., Manila, Metro Manila 1008, Philippines.

In these Terms of Service, “Tahanan Frames”, “Lit Studios”, “we”, “us” and “our” refer to this business, and “you” refers to the person who uses tahananframes.com or places an order with us.

2. About these terms

These terms apply when you browse our website, create an account or order a portrait. By placing an order you confirm that you have read and agree to them, together with our Privacy Policy and our Refund Policy. Before you pay, we show you our order terms and ask for your agreement; those order terms are reproduced in full in section 4 below.

You must be at least 18 years old to create an account or place an order.

3. Ordering and payment

To order, you choose your frame size, enter your contact and delivery details, and pin your delivery location on the map. After payment, you sign in to your account and upload the photos of the people you would like in your portrait.

All prices are in Philippine pesos (₱) and already include free delivery, both within Metro Manila and nationwide. The total shown before you pay is the amount you will be charged. If you allow us to use your portrait in our marketing (see section 6), ₱200 is taken off your total.

We accept payment through QR Ph, which you may scan with GCash, Maya or any bank app that supports QR Ph, and by Visa or Mastercard credit or debit card. Payments are processed by our payment provider, PayMongo, on its secure payment page. Your card details are entered with PayMongo directly; we never see or keep your full card number. Your order is confirmed once we receive confirmation of your payment.

If a price on our website is clearly wrong because of an error, we will contact you before production begins and you may choose to continue at the correct price or to cancel with a full refund.

Delivery timeframes shown on our website are estimates. We keep you updated on your order through your account and by email.

4. Order terms

The following order terms are the same terms you agree to under “Before you pay” when you place your order.

  1. Made to order. Each portrait is rendered and framed specifically for you. Once your order is confirmed and production has begun, it can no longer be cancelled or refunded, including for a change of mind. Refunds are likewise not given for issues beyond our control, such as delays or problems caused by the third-party courier or by the customer, including a frame left unclaimed and subsequently disposed of, or contact details that remain unreachable after our delivery attempts. In these cases no refund applies, as your digital copy has already been delivered as part of your order, and the remainder of the order could not be fulfilled for reasons attributable to the courier or the customer, not to any lapse on our part.
  2. Our creative style. The final rendering of your portrait is at our creative discretion and follows our signature colored-pencil style. We encourage you to view our gallery beforehand so that you know what to expect. Differences and variations in features, clothing or colours form part of this art style.
  3. Changes and refunds. Upon receiving your portrait, you may request up to three (3) free changes through your account. You will then select your final version, which serves as your downloadable digital copy and as the image we print and frame. Dissatisfaction with the style or the outcome does not qualify for a refund, as the portrait service delivered is the one you agreed to.
  4. Your photos. Your photos are used solely to render your portrait. They are processed by trusted service providers that we configure, under settings that keep them private and prevent their use for any other purpose.
  5. Accurate details. You are responsible for ensuring that your name, mobile number, email address and delivery address are correct and active. Deliveries that fail due to incorrect or unreachable details are not eligible for a refund.
  6. Metro Manila deliveries. We will contact you before delivery. After three (3) unsuccessful attempts to reach you, your frame will be held for pickup at Lit Studios – Manila Branch. As our storage space is limited, frames not claimed within 45 days from the date of purchase will be disposed of without refund.
  7. Deliveries outside Metro Manila. Every frame is carefully packed, and you will receive photos showing it fully intact together with your J&T Express tracking number. Your package is booked with J&T Express under your name as the receiver, with the delivery charge covered by us as free delivery. Once your packed frame is turned over to J&T, any damage, loss or delay in transit is the responsibility of the courier and not of Tahanan Frames or Lit Studios. We will provide our packing photos and assist you in filing a claim with J&T.
  8. Digital copy. Your digital copy is for personal use and may be downloaded from your account for six (6) months.
  9. Colours. Printed colours may appear slightly different from how they look on your screen.

5. Your account

Your account lets you upload your photos, follow your order and delivery, request your free changes, choose your final version and download your digital copy. You may sign up with your email address and a password, or continue with Google.

Please give accurate information and keep your password private. You are responsible for activity carried out through your account. If you believe someone else has accessed your account, tell us right away. We may suspend an account that is used in breach of these terms or of the law.

6. Your photos, your portrait and our work

Your photos

You keep all rights to the photos you upload. You confirm that you have the right to use them and the permission of the people shown in them, or that you are the parent or guardian of any child shown. You allow us to use your photos only to render, print, frame and deliver your order, as described in our Privacy Policy.

Your portrait

The portrait we make for you is for your personal use. You may display it, print it for yourself and share it with family and friends, including on your personal social media accounts. Commercial use, such as resale or use in advertising, requires our written consent.

Use of your portrait in our marketing

We use your portrait in our marketing and advertisements only if you ticked the marketing permission when you placed your order, in exchange for ₱200 off your total. Without that permission, we never use your portrait or your photos in our marketing. Your original photos are never used in marketing. You may withdraw your permission at any time by writing to us; we will then stop using your portrait in new materials and remove it from the channels we control, as far as reasonably possible. Withdrawing your permission does not affect the discount already given.

Our work

The Tahanan Frames and Lit Studios names and logos, our website, our gallery and sample portraits, and our text and designs belong to Lit Studios and may not be copied or used without our written consent.

7. Acceptable use

Please do not upload photos that you have no right to use, photos of people without their permission, or content that is unlawful, sexually explicit, hateful or meant to deceive or harm others. We may decline or stop an order that does not meet these standards. If we decline an order for this reason before production begins, we refund your payment in full.

8. Limitation of liability

We take great care with every order. To the extent allowed by Philippine law, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under Philippine law, or your rights as a consumer.

9. Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines, including the Consumer Act of the Philippines (Republic Act No. 7394), the Electronic Commerce Act of 2000 (Republic Act No. 8792) and the Internet Transactions Act of 2023 (Republic Act No. 11967).

If something goes wrong, please contact us first so that we can make it right. If we cannot resolve your concern, you may seek assistance from the Department of Trade and Industry. Any court case shall be filed in the proper courts of the City of Manila, without prejudice to any right you have under Philippine law to file elsewhere.

10. Changes to these terms

We may update these terms from time to time, and the date at the top of this page shows the latest version. The terms that apply to your order are those you agreed to when you placed it.
